Abstract
Lembor Village is located in Brondong District, Lamongan Regency, East Java Province. This village is known as an agrarian area where the majority of the population works as farmers. Agricultural land management plays a vital role in supporting the community's economic livelihood. One common form of cooperation practiced in this village is the telon system, a profit-sharing arrangement between landowners and cultivators, in which the harvest is divided one third for the landowner and two thirds for the cultivator. All production costs, including seeds, fertilizers, labor, and the risk of crop failure, are entirely borne by the cultivator. The primary reason for implementing this cooperation is that not all landowners have the time, energy, or capability to manage the land, while some farmers possess the necessary farming skills but do not own land. This system has been passed down through generations and has become a customary practice within the community. This research employs a qualitative method with a descriptive analytical approach. Data were collected through observation, interviews, and documentation. Theories used in analyzing the data include the concept of the mukhābarah contract, the principle of justice, and ‘urf in Islamic law. This study aims to provide an in depth analysis of the practice of agricultural land cultivation cooperation using the telon system in Lembor Village, Brondong Sub-district, Lamongan Regency, as well as to examine how Sharia Economic Law perceives and responds to this issue. The findings show that although this telon cooperation system has been practiced for generations and is rooted in local custom, it does not fully comply with the requirements of the mukhābarah contract particularly in terms of the clarity of contract duration and the unfair distribution of risk. The imbalance in responsibility sharing between landowners and cultivators reflects a practice that contradicts the principle of justice in Sharia Economic Law. Therefore, improvements are needed in the implementation of this agricultural cooperation, especially in agreeing on a clear duration of cultivation and ensuring a fair distribution of risk so that the cooperation is not only socially accepted but also in accordance with sharia principles.
