Abstract

The development of information technology and telecommunications puts Indonesia at number 10 on the global mailing list. The use of pirated software has been widely used, especially in graphic design providers. Yogyakarta is a province with most of its people educated by its many educational institutions. Buying up graphic design with pirated software has become a new business trend for some people is just another disturbing phenomenon. This is because of the use of a legally protected but generally used copyright for commercial purposes. In this study, the authors use field research, descriptive analytical using a deductive thinking framework. The approach used is legal sociology, where the authors sees directly in the public state related to the mechanism of purchasing the graphic design with pirated software and factors the influence it. The primary legal materials in the form of interviews, for secondary book stuffs in the form of law No. 28 of 2014 Firewat Copyright and Fatwa DS MUI Number: 1/Munas VII/MUI/5/2005 on Protection of intellectual property rights (HKI), and the tertical legal materials in the form of dictionary and encyclopedia. The results of this study show the reasons for the use of piracy software in graphic design trading among students at Yogyakarta in the backgrounds some factors: Economic, social culture, education, weak legal surveillance, with the economic factor that dominates it. The offense is listed in statute no. 28 of 2014. According to Islamic law, it states that it is not a façade, but it is the mauquf‘s principle, which is a legitimate for its satisfying. And both the conditions of origin and the requirements of authenticity, be implemented because of complete authority over the objects of akad. Akad mauquf‘s law is legal, only as a result of this suspended laws. The reprieve until it was ratified by the creator or canceled.
