Abstract

This research was motivated by the rejection of workers/laborers to the formation of Law No. 11 of 2020 concerning Job Creation, especially in the wage problems, then the researcher pursing again until this wage problem the researcher found in PP No. 36 of 2021 concerning Wages. The problem is that PP cannot be applied optimally, exacerbated by the Covid-19 Pandemic situation. The wage policy should be an effort by the central government to realize a decent livelihood for humanity, in fact the wage policy cannot be applied to every region, especially remote areas, because of differences in economic conditions and conditions regulated in PP No. 36 of 2021 concerning Wages. This type of research is library research with the nature of prescriptive-analytical research and uses a juridical-normative approach (statute law). The primary legal materials used in this study are the 1945 Constitution, Law No. 11 of 2020 concerning Job Creation, PP No. 36 of 2021 concerning Wages and regulations related to wages that have been changed, and the secondary legal materials used are the Quran and Hadith, fikih/usul fikih, books, journals, or scientific papers and others that can provide explanations related to primary legal materials. The analysis used in this study uses the theory of maqāṣid shariāh Jasser Auda as an analysis knife. The results showed that. First, The implementation of wage provisions as stipulated in PP No. 36 of 2021 concerning Wages cannot be fully implemented by entrepreneurs due to the pandemic which has greatly impacted the national economy. the implementation of wage provisions must indeed be seen from the current pandemic conditions, so that it then affects the ability of employers so that they do not maximize the provision of wages in accordance with what is demanded by workers / laborers, namely an increase in the minimum wage of 7%-10%. The wage provisions in Jasser Auda's maqāṣid using the six features of the approach system are partially appropriate (cognitive, and intended) for incompatible outcomes (simplicity, openness, interrelated hierarchy, and multi-dimensionality) therefore the maqāṣid to be achieved i.e. benefit is not fulfilled fully and thoroughly. Secondly, Through the perspective of Islamic legal philosophy, it shows better results, more corresponding than incompatible. Appropriate results (oneness/tawhid, functioning reason, cleansing oneself, freedom, gradually applied, human benefit, amar ma'ruf nahi mungkar, and tolerance). Unsuitable outcomes (equality, and equitable justice). Still, however, the government must always make continuous improvement efforts regarding the minimum wage issue.
