Abstract

Marriage is a sacred thing to legalize the relationship between a man and a woman. However, the fact is that in marriage there are still violations such as adultery, which is sexual intercourse between a man and a woman who is not bound by the ropes of marriage. Zina is an act that is prohibited in Islamic law and customary law. In Islamic law, it is clear that adultery is a serious offense and causes a major sin. In customary law, these violations certainly have an impact on social norms that will be ostracized by the community. This study aims to examine, first, how the customary fines for adulterers to get married in Nagari Salimpek. Second, how is the process of assimilation (cultural assimilation) between Islamic law and customary law for adulterers to marry in Nagari Salimpek, Kec. Gumanti Valley, Kab. solo. The type of this research isfield researchin Nagari Salimpek, and the nature of this research is descriptive. In the research process using data collection methods: observation, interviews, documentation, with 4 respondents and data analysis. This study uses a sociological approach, which is to examine or observe the practice of social life (social phenomena) that occur in the Salimpek community. The analysis used is qualitative with inductive method. The results of the study show that the customary fines that apply to adulterers who want to marry in Nagari Salimpek still use customary law by carrying out customary courts. The customary assembly determined animal fines such as: goats, cows, buffalo and so on according to the decisions of ninik mamak and traditional leaders who attended the trial. In this case, there is a process of assimilation between customary law and Islamic law regarding the determination of punishment for adultery in Salimpek village where customary law dominates, because in determining sanctions for adultery there, customary law applies in Nagari Salimpek.
