Abstract

Poverty is a very complex problem faced by the Indonesian government. As a mandate from the constitution, the government is obliged to prosper its people, one of the ways the government does in poverty alleviation is in improving the welfare of the community with the Family Hope Program. The Family Hope Program is a conditional social assistance to poor families that aims to reduce poverty and improve human quality by providing access to health and education services as well as social welfare. This program has been implemented since 2007 as part of the government's strategy to accelerate poverty reduction in the short and long term. This program is implemented in almost all regions in Indonesia as well as Polewali District, Polewali Mandar Regency, West Sulawesi. Therefore, the authors conducted research related to the analysis of government policies in the Family Hope Program in Polewali District. The formulation of the problem in this study is how the legal effectiveness of the analysis of government policy assistance from the Family Hope Program in improving welfare in Polewali District, Polewali Mandar Regency and how the analysis maslahah against government policy analysis in the form of the Family Hope Program in improving people's welfare. In this study, the type of field research (field research) is descriptive-analytical. This study tries to describe and analyze the problems above and then adapt them to the situation and reality in the field using an empirical juridical approach, namely legal analysis that has been conceptualized as a reality that includes social and cultural realities, both in terms of implementation and use in society. The data collection techniques used are interviews, observation and documentation. In addition, the theoretical studies used are the theory of legal effectiveness and the theory of maslahah. The results showed that the analysis of government policies in the form of the Family Hope Program assistance in improving the welfare of the community in Polewali District, Polewali Mandar Regency had gone well although it could not be said to be perfect. This can be seen from the decline in the poverty rate from 2018-2020, but in 2021 it will increase due to the Covid-19 pandemic. But at the implementation stage, there are still many people who have not felt the impact of this program. Based on the theoretical analysis of the factors of legal effectiveness in terms of five indicators, namely, the legal factor itself (laws and regulations); law enforcement factor; factors of supporting facilities or facilities; community factors; and cultural factors. Although the implementation stage of the Family Hope Program is not perfect, this program is very beneficial for poor families who are PKH participants, so that it is in accordance with the principle of maslahah.
