Abstract

Political rights are part of human rights that must be maintained, protected and guaranteed by the state equally for all groups without distinction of race, religion, ethnicity, nation or group including people with disabilities. In the 2019 presidential and vice-presidential elections, the City of Yogyakarta carried the theme of inclusive elections, which means prioritizing the political rights of every person with disabilities. This right is also supported by the background of DIY as an inclusion area and also Law Number 8 of 2016 which regulates the political rights of people with disabilities. So, the authors are interested in seeing the compatibility between efforts to fulfill these political rights from the perspective of Human Rights in Islam. This research was conducted to find out how the implementation of Article 13 of Law Number 8 of 2016 in the presidential election in the city of Yogyakarta in 2019. And to see how it is compatible with human rights in the Islamic concept. This research is a qualitative research with an empirical juridical approach that is looking at the implementation of a policy in the field. In collecting data, this study uses source triangulation techniques by obtaining data from different sources by means of observation, interviews and documentation. The results of this study found that the implementation of Article 13 of Law Number 8 of 2016 in the presidential election in Yogyakarta City was in accordance with human rights in the Islamic concept which requires brotherhood, freedom and equality. These principles are implemented through every stage of the election, from data collection to the role of persons with disabilities in the administration of elections. However, this still faces several obstacles, such as accessibility that does not include all people with disabilities or data collection that does not cover all disabilities.
