Abstract

The COVID-19 pandemic has made the election campaign activities in 2020 carried out with a method that is quite different from before. If campaigns are usually carried out by gathering the masses, then the campaign method in PKPU Number 13 of 2020 is dominated by the use of technology and restrictions on the number of participants. PKPU Number 13 of 2020 was made by the KPU in order to guarantee the right of voters to information about candidate pairs by prioritizing the principle of safety. The application of the campaign method in this regulation is problematic for areas experiencing internet limitations. Of course this has an impact on the delivery of information to voters. This thesis examines PKPU Number 13 of 2020, especially regarding the election campaign method in the midst of the COVID-19 pandemic, analyzed using the priority theory of legal basic values and the theory of maṣlahah. The type of research is library research which emphasizes the acquisition of data sourced from books, journals, laws and regulations and so on. With the nature of descriptive analytic research. Research data collected from reading the text which is then described and analyzed using the priority of the basic values of law and the theory of maṣlahah. The results of this study show that the election campaign method in the midst of the COVID-19 pandemic in PKPU Number 13 of 2020 raises a priority on the basic legal values, namely casuistic priorities where the legal basis values are prioritized in the COVID-19 pandemic situation, prioritizing the value of expediency, certainty, and justice, as for the benefits of this campaign method to prevent the transmission of COVID-19 in campaign activities, so from the level of maṣlahah importance, prioritizing life safety is maṣlahah at the dharuriyyah level.
