Abstract

This research is motivated by the absence of laws and regulations related to the limitation of periodization of Dewan Perwakilan Rakyat, so that there is a legal vacuum, the problem of the periodization absence of the officals position is important because it is seen from the history of past authoritarianism in the form of abuse of power. Because there are many cases of officials in Indonesia often abuse their power. Based on the problems that have been described previously, the authors formulate into two main problems, namely what is the urgency of limiting the periodization of members of Dewan Perwakilan Rakyat in Indonesia and what is the perspective of maslahah mursalah on these problems. This research uses the type of library research. The approach used is juridical-normative, which is an approach based on the main legal material by examining theories, concepts, legal principles, cases, comparisons, and laws and regulations related to this research. As well as using an analytical approach, namely analyzing the legal aspect of the object of study based on the theory that has been determined in the research. The results of this study resulted in 3 urgency factors for limiting the periodization of the offical of members of Dewan Perwakilan Rakyat: First, the legal vacuum. Second, abuse of power takes the form of corruption. Third, leadership regeneration. In addition, in the perspective of maslahah mursalah, this is included in the level of public benefit (maslahah al-ammah) for the nation and state, people and also the government. This benefit can be felt by all Indonesian people without exception.
