Abstract

The participation of career wives in earning a living in the public sphere results in a dual role in the household. One form of a career wife is a wife who works as a judge. High income as a female judge results in the dominance of the wife's livelihood over her husband so that it affects the husband and wife relationship in the household. The Yogyakarta Religious Court recorded nine female judges out of a total of fourteen judges, twice the number of male judges. The dominating livelihood affects the existence of the husband as the breadwinner, and at the same time opens space for the wife to be less than optimal in taking care of the household due to her dual role. The presence of the concept of mubādalah then becomes the most logical choice in an equal relationship to answer the husband and wife relationship. This study aims to identify the influence of the wife's income on the husband and wife relationship in the household, especially regarding the dominance of the livelihood of female judges in the Yogyakarta Religious Court. Then examine further its influence on family function. The focus of this study will be answered using the concept of mubādalah Faqihuddin Abdul Kodir with qualitative research methods and using a gender approach. The results of this study were from five female judge respondents, which showed that the wife's income had an influence on three husband-wife relationships, including: relations in terms of providing a living by the husband, decision-making power relations and relations in terms of the division of household domestic roles. In terms of providing a living, it includes the provision of a living by the husband in its entirety, not completely and not at all. In terms of decision-making power relations, namely: joint decisions of husband and wife and absolute decisions by wife. Finally, in terms of the division of household domestic roles, it includes: a balanced division of labor and a heavier division of labor for the wife. Women judges participate in working to earn a living not because of a lack of livelihood from their husbands, but because of awareness and independence. They believe that when the wife has the ability and opportunity to work, the wife must participate in helping her husband to improve the family's financial capacity. The interdependence applied by the female judge and the husband is in line with and is in accordance with the mubādalah concept introduced by Faqihuddin Abdul Kodir, namely that living and domestic affairs of the household are shared duties and responsibilities in the family. The transfer of function that occurs due to the dual role of female judges in the Yogyakarta Religious Court is natural to do, because it is in accordance with Islamic law, and brings many benefits in the family.
