Abstract

This research is motivated by the problem of child labor which until now has not received special attention in the community. Meanwhile, in the eyes of the law, child labor is likened to a gem that must be protected and fulfilled by its needs. Child labor has the connotation of the practice of employing children under the age of 18 with minimal wages and negatively affects their growth and development. This study examines the violation of the rights of child labor in sand mines with a focus on analysis from a cultural and legal point of view. This study took samples in Lea Village, Tellu Siattinge District, Bone Regency. The selection of the locus is based on indications of violations of the rights of child labor. This research uses qualitative methods with a descriptive approach. The selection of informants as subjects was carried out by purposive and snowball sampling. The number of informants in this study was 20 people consisting of six child laborers, six child labor parents, three community leaders, and five people from the local government. Data were collected using observation, interview, and documentation techniques. Data analysis is carried out in three ways, namely data reduction in the form of mapping, display data, and conclusion. The results showed that the application of existing laws and regulations has not been in favor of child labor. This is proven by the discovery of several forms of rights violations that occur in child labor, including the right of children to get an education, the right of children to learn, the right of children to their health, and the right of children to be protected. Some of the efforts that have been made by the government and non-governmental organizations have not shown the expected results. Among the factors behind the government's inadequacy are weak law enforcement, lack of cooperation between village governments and city governments, child labor is not considered a social problem, limited human resources and budgets, and the elimination of child labor programs. This is what makes efforts to protect the rights of child labor dilemmatic for the government.
