Abstract

The rise of buying and selling fish in the community has given rise to various new buying and selling systems that are more creative and efficient in order to benefit from the business that has been carried out.Especially for anglers who want to easily buy fish not only in the market or supermarket but in the fishing pond, so that anglers can at the same time channel their hobbies and get the sensation of buying fish.There are several fish buying and selling systems carried out by fishing pond business people that bridge the anglers, including the Daily, Lapakan, and Borongan systems. The type of research used in this study is a type of qualitative research.The subject and object of this study is buying and selling fish in a fishing pond located in Barak 2 Hamlet, Margoluwih, Seyegan, Sleman, D.I.Yogyakarta.The data collection carried out in this study used two types of data, namely primary data and secondary data.The data analysis technique in this study uses interactive model data analysis which has three important components, namely data reduction, data presentation, and drawing conclusions.The theory used in this study uses a review of the theory of muamalat jurisprudence and the sociology of Islamic law.Based on research in the field, the author analyzes buying and selling with a daily system, lapakan (galatama) and wholesale in barracks fishing ponds using Fiqh Muamalat and sociology of Islamic law. The results of research on buying and selling fish with a daily system, lapakan (galatama) and wholesale in the Barracks 2 fishing pond using Fikih Muamalat and the sociology of Islamic law.In the analysis of the first Muamalat Jurisprudence daily system, where in this system if the contract used for buying and selling, the applicable law is haram because there is no clarity of the object to be purchased, but if the contract used is a legal lease that applies to this system, it can be fiqh muamalat.The lapakan system in view of the muamalat fiqh of the applicable law is invalid and haram because it contains elements of gambling in the system, but if in the system there is one muhalil then the law that applies to the system is considered mubah.In the sociological analysis of Islamic law, of the three systems that have been discussed starting from the daily, lapakan (galatama) and wholesale, judging from the cultural, social and individual systems, all three still operate because they get a role from local customs supported by militancy and deep-rooted hobbies.
