Abstract

The high number of accidents caused by underage motorists is still a challenge for law enforcement officials to overcome. Traffic accident definitively according to Law Number 22 of 2009 concerning Road Traffic and Transportation (LLAJ) Article 1 paragraph (24) is an incident on the road that is unexpected and unintentional involving a vehicle with or without other road users resulting in victims human and/or property loss. The study entitled "Solving Child Cases in Traffic Accidents That Caused the Victim to Die (Case Study at the Bantul Police)", aims to determine the role of the Bantul Resort Police (Polres) in handling cases of traffic accidents in children that cause the victim to die, and to find out efforts to resolve cases of children in cases of traffic accidents that caused the victim to die in the work area of the Bantul District Police. The research method used includes the type of field research in which data and information are sourced from field data directly. This research is descriptive-analytical, which describes the analysis of researchers regarding the settlement of cases of children in traffic accidents that caused the victim to die, which reveals the laws and regulations, as well as those related to the legal object of the study. The theories used in conducting this research are the theory of the criminal justice system, the theory of penal and non-penal, the theory of diversion, and the theory of justice. The role of the Bantul Police in handling the process of resolving traffic cases in children that result in the death of victims using penal and non-penal policies. Efforts to resolve traffic cases carried out by children are determined by diversion efforts, where the perpetrator assists with medical expenses at the hospital, funeral expenses and costs of 7 (seven) days to 1000 (one thousand) days to the second party of the deceased victim of Rp. 50,000,000,- (fifty million rupiah) in cash. The perpetrator also helped with medical expenses at the hospital, and vehicle control and damage to the third party in the amount of Rp. 10,000,000,- (ten million rupiah).
