Abstract

A marriage can be said to be valid if the pillars and conditions that have been determined have been fulfilled both according to Islamic law and positive law in Indonesia. Indonesia itself is a country that has ethnic and racial diversity, where each community has its own customs or traditions. This cultural diversity sometimes affects the legal provisions that have been regulated. One of them is the custom itungan adopted by the Buaran community in determining the timing of the marriage contract. The majority of the people of Buaran apply the custom itungan as an additional requirement in determining the time of the marriage contract, which is neither a pillar nor a condition of marriage, both contained in Islamic law and positive law in Indonesia. The type of research used is a field research. The approach used in this study is a sociological approach to Islamic law. The Nature of research is a descriptiveanalytic which aims to: explain, describe and clarify objectively the data studied and then analyze it based on the sociological theory of Islamic law to create a more indepth and not monotonous research. The results showed that the factors for the application of itungan customs to the people of Buaran District were the preservation of customs, good day beliefs and bala' rejections as well as parental factors. The preservation of the customs of the people of Buaran District is carried out as a form of respect for the predecessors. The second factor is the confidence of the people of Buaran District in the existence of a good day and avoiding disasters or commonly referred to as tolak bala'. The last factor is parents as a determinant of the timing of the implementation of the marriage contract. Most brides-to-be are unaware of the customs, they just obey what their parents suggest. The people of Buaran Subdistrict go through several stages or concepts until they can legally become husband and wife starting from the application process for the bride and groom then determining the day of the implementation of the marriage contract where at this stage the custom is applied, then continuing to the level of implementing the marriage contract until it is valid. Itungan customs became a damaged custom because the people of Buaran District made this custom a necessity or obligation to be applied. Couples do not hesitate to cancel their marriage if the custom is not applied as a determinant of the timing of the implementation of the marriage contract.
