Abstract

Indonesia is one of the countries with the largest biodiversity in the world. This diversity does not escape the threat of damage caused by land conversion, forest fires, illegal tree cutting, hunting and illegal trade in animals and plants. Protection of biodiversity is regulated in Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems. The problem that is quite massive is threatening the preservation of animals, namely the illegal trade in protected animals because they collect animals to be sold by taking them directly from nature. Institutions involved in implementing these regulations include BKSDA, law enforcement agencies and WRC. This study discusses the effectiveness of Law Number 5 of 1990 concerning KSDAE in dealing with the illegal trade in protected animals in Yogyakarta. The type of research used is field research with a normative juridical approach to determine the effectiveness of the law and review of syasah dusturiyah. The method of analysis used descriptive analytic. Collecting data by means of interviews, observations and data from documents that support and are related to the research theme. Research conducted on the effectiveness of Law Number 5 of 1990 concerning KSDAE in dealing with the illegal trade in protected animals in Yogyakarta found that there are articles that need to be updated in the criminal provisions in order to contain minimum punishment sanctions so as to further increase the threat of punishment for conservation violators as well as in the provisions for the preservation of plant and animal species in article 21, the provisions for several violations are still in one article so that legal violators cannot be subject to multiple articles. The BKSDA, Police, Prosecutors and WRC institutions in carrying out their duties are in accordance with the record that there needs to be an increase in performance so that the implementation of the law is maximized. Siyasah dusturiyah in reviewing law reform must pay attention to the principles of Islamic teachings in making regulations.
