Abstract

Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) in order to increase the effectiveness of the provisions in Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 11 of 2016 concerning Settlement of Land Cases, Ministry of Agrarian and Spatial Planning/National Land Agency ( ATR/BPN) stipulates Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases. This study aims to find out how to resolve cases of overlapping land certificates at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) and the efforts made by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) so that there is no overlapping of land certificates. This type of research is field research, namely by direct observation of the implementation of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) Number 21 of 2021 concerning Handling and Settlement of Land Cases at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency ( ATR/BPN). The approach in this study uses an empirical juridical approach. This research is descriptive in nature, namely the research clearly describes various matters relating to the object under study, namely the settlement of cases of overlapping land certificates at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) and the efforts made by the Ministry of Agrarian Affairs and Forestry. Spatial Planning/National Land Agency (ATR/BPN) in order to avoid cases of overlapping land certificates. The method of collection used the interview and documentation method. The results showed that the settlement of cases of overlapping land certificates at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) by canceling one of the land certificates which was considered legally flawed and or administratively flawed. In order to prevent overlapping cases of land certificates, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) made several efforts, namely increasing human resources (HR) in the field of measurement and mapping, conducting socialization of land law by the Head of the Office of the Ministry of ATR. /BPN to village communities, improve measurement and mapping equipment at Regional Offices and Land Offices, conduct guidance and monitoring to regional offices and land offices on overlapping cases, and conduct a Complete Systematic Land Registration (PTSL) program.
