Abstract

The job copyright law is the government's goal in efforts to create jobs by providing convenience, providing protection and empowering micro, small and medium enterprises, improving the investment ecosystem and facilitating business and investment initiated by the central level government and accelerating national projects that are strategic. Thus, the enactment of Law Number 11 of 2020 concerning Job Creation was rejected and gave rise to dissatisfied opinions from most Indonesian people with different levels of legal perceptions. There are many things that are questioned by trade unions, the existence of the Job Creation Law threatens human rights (HAM), one of which is the issue of severance pay or termination of employment (PHK), which is reduced to 25 times wages from the previous 32 times wages. So that researchers will compare the rights of workers/laborers in the Labor Law (Law No. 13 of 2003) with the Job Creation Law (Law No. 11 of 2020) related to Maqashid sharia. This type of research is library research, which is descriptive-analytic in nature and uses a normative legal research approach. The analytical method used is a philosophical and comparative approach. The data collection technique was carried out by studying the literature on legal materials and analyzed by collecting library materials by giving good reviews in the form of opposing, criticizing, supporting then analyzing and making conclusions. The results of this study indicate that the provisions of the Job Creation Law in providing protection for workers/laborers have not received the welfare as the Employment Law. One of them is in the worker's right to severance pay because in Law No. 13 of 2003 work reward pay is still regulated in Article 156. So Law No. 13 of 2003 concerning employment is more in line with the rights needed by workers/labourers in the theory of protection workers rights law. In the Maqāṣid Asy-Syari'ah analysis of Law No. 13 of 2003 concerning employment, the existence of more maslahah seen from the perspective of Hifdz an-nafs (protection of the soul), Hifdz al-aql (protection of the mind), and Hifdz al-mal (protection of the treasure). Meanwhile, in the Copyright Law, it is seen from the perspective of Hifdz an-nafs (life protection) and Hifdz al-mal (property protection).
