Abstract

The Indonesian state actually has a responsibility for the welfare of the community, because the effort that can be done is to pay more attention to the use of philanthropy. One form of state attention to this is the issuance of Law Number 9 of 1961 concerning the Collection of Money or Goods, which is then abbreviated as CMG regulations. This law is expected to be a state policy that is able to overcome problems in collecting money or goods so that in the end prosperity can be achieved. However, the law is considered irrelevant to the current situation and conditions because there are shortcomings in terms of law enforcement, accountability, and the use of technology. This issue is then raised in this research, what are the legal implications of the law in the development of philanthropy in Indonesia, and how Maqasid Shari'ah views the law. This research is a type of normative juridical research which can also be called library research with a legal and analytical approach. Data analysis was carried out by collecting relevant legal materials, then processed and analyzed logically and comprehensively in accordance with the existing theoretical framework and presented in a qualitative form. The results of this study indicate that the legal implications of the CMG regulations can be seen from several aspects contained in the principles of good governance. Overall, the legal implications of the CMG regulations result in legal uncertainty and legal disorder, which includes more activities to collect money or unlicensed goods, loss of public trust, troublesome organizers in terms of licensing, and the huge potential of philanthropy in Indonesia that cannot be fully utilized. Then Maqasid Myari'ah on the CMG regulations can be said that there is a good purpose for the policy in achieving human benefit. However, this good goal is not supported by the provisions contained in the CMG regulations. Based on the 6 (six) features of the systems approach developed by Jasser Auda, only the overall features and related hierarchies have been fulfilled, while the cognitive, openness, multidimensionality, and intentional features have not been fulfilled.
