Abstract

This research is motivated by the low electability rate of women in the legislature in Indonesia. One of the legislative institutions in Indonesia that has problems with the low number of women's electability is the Regional People's Representative Council of North Sumatra Province. Since the presence of government policies contained in Law No. 12 of 2003 concerning the establishment of a quota of 30% of women's political representation in the legislature in the 2004 elections until now, In fact, the policy has not been able to increase the number of women's electability in the legislature. The number of men is still above the number of women. Even the 30% figure for women in the legislature has not been reached. So far, the maximum number of women elected in the Regional People's Representative Council of North Sumatra province is only 13 people out of a total of 100 people. Of course, the policy needs to be improved again until finally the policy can be a solution to the crisis of women in politics. This type of research is library research with the nature of preskiptiveanalytical research and uses a juridical-normative approach (statute law). The primary legal materials used in this study are the 1945 Constitution, Law No. 10 of 2008 concerning the Election of the DPR, DPD and DPRD, Law No. 39 of 1999 concerning Human Rights and Law No. 8 of 1958 concerning guaranteeing equal political rights between men and women. And the secondary legal materials used are the Quran and Hadith, fiqh / fiqh proposals, books, journals, or other scientific papers that can provide explanations related to primary legal materials. The analysis used in this study uses the theory of legal equations and maqᾱṣid syarῑah Jasser Auda as an analysis knife. The results showed that. First, the implementation of gender equality on the provision of 30% female representation in the legislature as stipulated in Law No. 10 of 2008 concerning the Elections of the DPR, DPD and DPRD has not been fully implemented by women Because even though the determination of the number of women's representation has been determined. However, due to the low political representation of women because of the low political representation of women in the Regional People's Representative Council of North Sumatra Province due to family, economic, patriarchal culture and weak female caleg ability in politics. The implementation of women's political provisions in representation requires the contribution of women who want to enter politics Secondly, through the perspective of maqᾱṣid syarῑah Jasser Auda using the six features of the approach system there are several appropriate (cognitive, openness, interrelated hierarch,, and purposefulness). For an incompatible result (comprehensiveness and multi-dimensionality) therefore the maqᾱṣid to be achieved is that the benefit has not been fulfilled fully and thoroughly.
