Abstract

There are still many child riders in society. In Law Number 22 of 2009 concerning Road Traffic and Transportation, it has been stated that a person is allowed to ride a motorbike at the age of 17. For various reasons, parents allow their children to ride motorbikes. Even though this can endanger children in Genting Village because children still have unstable emotions. On the other hand, children tend to drive recklessly on the road. So this study aims to see what are the causes of motorcyclists by children in Kadipiro Village, Cepogo District, Boyolali Regency when viewed from the theory of the legal system. This research is a descriptive field research. The approach used in this research is sociological empirical. The data collection method was carried out through observation and interviews with children, parents, other road drivers, and the Boyolali District Traffic Police. The analysis used is qualitative data analysis. Based on this research, it was concluded that driving by children in Genting Village was caused by family factors, child association, children's desires, lack of transportation facilities, and being able to make things easier. If viewed using Lawrence M. Friedman's legal system theory, if viewed through the legal structure, the police have made repressive and preventive efforts. In terms of legal substance, according to Law Number 22 of 2009 concerning Road Traffic and Transportation, children under the age of 17 are not allowed to ride motorbikes. However, the children in Genting Village felt safe riding motorbikes because they only rode on village roads and avoided fines. Moreover, in terms of legal culture, the majority of Genting Village people do not understand the applicable traffic regulations. Coupled with the factors of poverty and low education, the people of Genting Village do not provide enough understanding to their children about the importance of obeying traffic rules.
