Abstract

The City of Yogyakarta as the Capital of the Province of the Special Region of Yogyakarta which experiences a lot of social problems due to the high intensity of economic movements. One of the social problems that occur is the practice of begging. As for the city of Yogyakarta itself, there are no regional regulations governing the handling of begging, so the rules for handling begging still refer to Yogyakarta Special Region Regulation No. 1 of 2014 concerning Handling of Homeless and Beggars. This then raises the question: First, what are the penal and non-penal efforts towards beggars in the city of Yogyakarta. Second, what factors hinder penal and non-penal efforts against beggars in the city of Yogyakarta. This study uses empirical legal research methods and the research approach used is empirical juridical and data collection techniques using interviews with Mr. Edy Kusnandar, S.Pd., M.M., Head of HR Capacity Development for Satpol PP Yogyakarta City. Mrs. Inneke Dian Kurniasih, S.H., Head of Guidance, Supervision and Counseling for the DIY Prov Satpol PP. Mrs. Ismi Sulistiani, S.Sos., MPA., Head of the Social Rehabilitation Sub-Division for Social Disadvantages of the DIY Province Social Service. Mr. Wito, the perpetrator of begging and Mr. Moch. Arif Satiyo Widodo, S.H., M.H., Yogyakarta District Court Judge and literature study and using descriptive qualitative data analysis methods. The results of this study are that the implementation of penal and non-penal efforts against beggars in the city of Yogyakarta is still not effective because there are several inhibiting factors in the form of the absence of regional regulations in the city of Yogyakarta that regulate the handling of begging, the imposition of criminal sanctions against beggars still does not have a deterrent effect because the sentence handed down was lower than the legal threat in Yogyakarta Special Region Regulation Number 1 of 2014 concerning Handling of Homeless and Beggars, as well as non-penal efforts through coaching of beggars have not yet been implemented in accordance with Yogyakarta Special Region Governor Regulation Number 36 of 2017 concerning Operational Standards Procedure for Handling Homeless and Beggars.
