Abstract

The elopement term "laghi kawin" has made the people of Babeko Hamlet more well-known. In practice, elopement in the Babeko hamlet is the same as elopement in other parts of Indonesia: a man will bring or invite a woman to run or go somewhere together with the intention of getting married, Additionally, the position on the practice of elopement is the same as that of several other regions, where it is recognized as a violation of the law, The perpetrators will receive customary punishments in the form of a prohibition on holding weddings (walimah al-'urs) because this practice is illegal. This is a fascinating phenomenon to investigate through two discussions: why did eloping occur in the Babeko sub-village, and why did the Babeko hamlet and Babeko intersection apply different penalties to elopers. This study employs a sociological approach to empirical legal research, In the context of a community's customs, the purpose of this study is to investigate the elopement practice in the Babeko hamlet and its legal implications. On the other hand, the theory used in this study is theory receptio a contrario, and it focuses on the connection between Islamic law and customary law. The primary and secondary data gathered through interviews, documentation, and literature reviews comprise the first two categories of data used in this study. Qualitative analysis of all collected data produced descriptive data and utilized analysis. According to the findings, three factors contributed to the practice of eloping in the hamlet of Babeko: First, the desire to marry immediately without going through the standard process. Second, a relationship that parents or family do not approve of. Thirdly, prior to getting married, the woman already had a baby. In contrast, the imposition of sanctions on elopement perpetrators is solely customary and does not violate Islamic or state regulations, which is why the application of sanctions for the prohibition of weddings in Babeko hamlet and Babeko intersection differs. In addition, the conflict between Islamic law and customary law regarding the prohibition of elopement and the penalties for elopement perpetrators in the form of a prohibition on hosting a wedding party do not violate Islamic provisions.
