Abstract

State-owned banks or (himbara), namely: PT Bank BRI Syariah (BRIS), PT Bank Syariah Mandiri (BSM), and PT Bank BNI Syariah (BNIS). This breakthrough government policy to merge three Islamic banks is expected to give PT Bank Syariah Indonesia TBK, hereinafter referred to as BSI, officially operating on February 1, 2021. The government policy breakthrough to merge three Islamic banks is expected to provide a choice of new financial institutions for the public while being able to boost the economy national. As is well known to date, the three merged Islamic banks have their own advantages. For example Bank Syariah Mandiri, which is known for its work system and professionalism, Bank BNI Syariah with its innovation capabilities, and BRI Syariah with local and regional understanding so that many predict BSI will become agile and more competitive with conventional banks which are currently more dominant. This Sharia Bank Merger has a strategy which is a corporate action or an action taken which aims to achieve the goals desired by the company and is able to increase value for stakeholders and have a positive impact on shareholders. This thesis research uses library research (Library Research). In this study, the authors collected data from existing research and summary reports on mergers carried out by three Islamic banks, namely Bank BRI Syariah, Bank Syariah Mandiri and Bank BNI Syariah and the impact of mergers on Islamic banking in Indonesia, especially Bank Muamalat Indonesia, which was analyzed using Mas' perspective maslahah. The results in this study are that the BUMN Syariah Bank Meger has implemented the Maqhasid Syariah rule, because the implementation of the BUMN Syariah Bank merger aims to carry out the Shari'a so that human welfare can be realized, in other words the Syariah Bank Merger has a goal for the good or benefit of mankind. In carrying out the merger of BUMN Syariah Banks, it is necessary to consider aspects of the interests of the people, especially Muslims, so that in muamalat there are also aspects of worship so that Muslims can carry out sharia in a kaffah manner. The legal consequences of not implementing the maqashid sharia rules in the merger of BUMN Syariah Banks according to Islamic law are contrary to the principles of Islamic law and sharia principles because the application of the maqasid sharia rules is to protect religion, soul, mind, property and offspring, so that Muslims are prevented from unlawful and illegitimate property. This is what Muslims must pay attention to in carrying out muamalat in their daily lives so as to avoid things that are forbidden, so that it can cause harm both for themselves, as well as for their families and society.
