Abstract

Judiciary must meet the expectations of justice seekers who always want a trial that is fast, precise, fair and low cost. There is no need for complicated examinations and procedures that can take years for the process, sometimes even the heirs seeking justice must be continued. The lowest possible cost so that it can be borne by the people. This is all without sacrificing thoroughness to seek truth and justice. This study aims to clearly determine the application of the principle of simple, fast and low cost at the Bima Religious Court in the divorce case filed against Number: 0671/Pdt.G/2019/PA.Bm which is known to have lasted for almost 8 months and to find out the factors which affects the principle of simple, fast and low cost at the Bima Religious Court in a contested divorce Number: 0671/Pdt.G/2019/PA.Bm. The type of research is library research (field research). Data collection techniques using the documentation method. The approach used in this study uses an empirical juridical approach, namely research that is directly carried out in the field to find out the problems that actually occur, then connected with the applicable laws and regulations and existing legal theories. Data collection techniques by way of observation, interviews, documentation. The data analysis technique uses qualitative analysis methods, using all collected data and then analyzing it in a deductive manner, namely exposing from general to specific matters by way of thinking that is born from existing theories or rules. This research was conducted at the Bima Religious Court using data collection techniques by means of field research with the results of the research that the application of the principle of simple, fast and low cost at the Bima Religious Court even though it appears to be in accordance with the provisions of civil procedural law in the religious courts that apply in Indonesia, however, in practice in the field there are still many obstacles to implementation, such as the divorce case filed No: 0671/Pdt.G/2019/PA.Bm which is known to have been in the process for almost 8 months. As for other obstacles that occurred at the Bima Religious Court so that the process of applying the principles took a long time, due to errors in the court's online service, and other factors from irresponsible individuals such as brokers. And the obstacles in applying the principle of simple, fast and low cost at the Bima Religious Court in case No: 0671/Pdt.G/2019/PA.Bm were also caused by the fact that the Defendant did not appear before him nor did he order others to appear before him. as its legal representative or proxy.
