Abstract

Dewan Perwakilan Rakyat (The House of Representatives) is one of state high institutions within Indonesian state administration system that represents the people. The House consists of political party members who are participants and selected in general election. Ahlul Halli Wal Aqdi refers to the people who have the authority of loosening and tightening, which can also be addressed as an institution created according to the format team founded by Umar ibn Khattab in his caliphate to choose a leader. This study discusses the comparison of several aspects regarding both institutions in terms of membership system, rights, obligation, authority, as well as duty, aiming to clarify their connection and whether the House’s application system is in line with Ahlul Halli Wal Aqdi. Furthermore, recommendations based on the concept of application system will be offered for the House of Representatives. The study is classified as library research which applied qualitative approach and comparative method as it compares the House of Representatives and Ahlul Halli Wal Aqdi. Meanwhile, descriptive analysis method was applied in the data analysis stage. The data was collected by reviewing the Act, books, and scientific journals related to the House of Representative and Ahlul Halli Wal Aqdi. The study results explain and conclude that Dewan Perwakilan Rakyat (the House of Representatives) and Ahlul Halli Wal Aqdi are the institutions that face the people directly as their representatives in solving the existing problems. However, the House’s duty is to represent the people to convey their aspirations and needs, as well as to represent the government in setting rules for them. On the other hand, Ahlul Halli Wal Aqdi’s duty is to represent the people to convey their aspirations in electing a leader or a head of state. The relevant recommendations for the House based on the concept of application system of Ahlul Halli Wal Aqdi relates specifically to the membership system which needs re-assessment to improve the performance quality of each member of the House in the future. Additionally, the House of Representatives can be addressed as an image form of the practical system in Ahlul Halli Wal Aqdi with its more organized and detailed system in the legalized act.
