Abstract

PT. Anugerah Putera Jaya is a company located in Temanggung Regency. Companies engaged in the field of properti, especially housing with government subsidies. Government subsidized houses are identified with credit payments, namely home ownership loans or abbreviated as KPR. Sales of subsidized houses with this mortgage, PT. Anugerah Putera Jaya has several problems, such as consumers who do not understand about mortgages and subsidized houses. Some consumers complain about building specifications that have hidden defects. The problem must be resolved by the developer, about how to solve it will then be examined by the author. This type of research is field research with a normative juridical approach. While the data analysis method used is descriptive analytics. In the data collection method, the compiler uses observation, interview, and documentation methods. Field observations were conducted at PT. Anugerah Putera Jaya develops subsidized housing in Temanggung Regency. Interviews were also conducted directly with developers and consumers. The results showed that PT. Anugerah Putera Jaya provides legal protection in the form of house sale and purchase transactions using agreements made and witnessed in front of a notary. When problems arise between the company and consumers PT. Anugerah Putera Jaya, the company already has a mechanism to solve it such as helping to make financial statements for consumers who work as entrepreneurs, but in its business there are no clear financial statements and can be reported as a condition for applying for a mortgage. Problems such as hidden defects in residential buildings, the developer will make repairs as soon as possible until consumers are satisfied and in accordance with the specifications of the house offered. It can be concluded from the two research results that, based on Law number 8 of 1999 concerning Consumer Protection PT. Anugerah Putera Jaya is appropriate in terms of protecting the rights of its consumers legally.
