Abstract

Marriage is an important event that must be recorded to the Marriage Registration Officer which aims to provide legal protection and certainty. However, there are still many people who are reluctant to register their marriages due to various factors. Then the government began to facilitate the creation of KK by attaching a Statement of Absolute Responsibility (SPTJM). In accordance with the Regulation of the Minister of Home Affairs of the Republic of Indonesia Number 9 of 2016 concerning the Acceleration of Increasing the Coverage of Birth Certificate Ownership which explains that "In the event that the requirements in the form of a marriage certificate/marriage certificate citation as referred to in Article 3 paragraph (1) point b are not met, the applicant attaches the SPTJM truth as a married couple". The goal is that people still feel their rights without discrimination. This type of research is empirical juridical, which examines applicable legal provisions and what happens in reality in society. This research is descriptive analytical, which describes laws and regulations associated with legal theories and positive law implementation practices related to problems. The approach in this study uses an empirical juridical approach, namely legal research on the application or implementation of normative legal provisions directly on each particular legal event that occurs in society. The data collection method uses interview methods, literature studies and documentation. The results showed that the implementation of making KK by attaching SPTJM truth as husband and wife was not appropriate in the perspective of aspects of legal protection, legal certainty and legal justice. Then the implications of making KK by attaching SPTJM the truth as husband and wife are also not appropriate if they are related to laws and regulations. According to the author, this discrepancy requires a revision of the provisions for making the KK which is adjusted to several aspects and laws and regulations that have been in effect before. The revision aims to provide continuity between several aspects and applicable laws, so as not to cause multiple interpretations and more easily accepted by the community.
