Abstract

Technological developments have in fact influenced various domains, including the realm of proving the criminal act of buying and selling narcotics. Where in the past, transactions usually used cash payments, but now almost all transactions are with electronic payments. These electronic transactions will certainly have an impact on evidence, especially evidence obtained at the investigation stage. In addition, these transactions are also considered to have an influence on the level of complexity of searching and collecting evidence of criminal acts for investigators, especially DIY Provincial BNN Investigators. Moreover, the scope of the DIY BNNP is wider than the other district/city BNN in DIY. The problems raised in this study, namely the process of proving the criminal act of buying and selling drugs based on e-payment at the DIY Provincial BNN, the obstacles experienced during handling cases of buying and selling drugs based on e-payment at the DIY Provincial BNN, and strategies to overcome the existence of buying and selling drugs based on e-payment in the process of proving criminal acts at the DIY Provincial BNN. This research is a field research whose data is obtained from DIY BNNP Investigators and then analyzed descriptively-qualitatively. Then this research is descriptive analytical compiled using a juridical-empirical approach from data sources collected from interviews, literature studies, and documentation. This research will be based on the theory of evidence as well as the theory of crime prevention and control. Based on the data obtained, it was found that the process of proof by BNNP DIY Investigators related to the criminal act of buying and selling narcotics based on e-payment is based on the Criminal Code, Criminal Procedure Code, Law Number 35 of 2009 concerning Narcotics, and Law Number 8 of 2011 concerning Electronic Information and Transactions and its amendments (Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions). The process itself takes an average of 60 days from stage one to stage two. The obstacles faced include the difficulty of opening a checking account on behalf of another person plus there is no specific regulation that allows BNN Investigators to open their own checking account, the difficulty of proving cases with BRILink transactions, lack of understanding between investigators and prosecutors. The solution is in the form of cooperation with banks, making MoU with PPATK, and internal strengthening of investigators.
