Abstract

In the household building, each husband and wife has the right and obligation. Those two components are the responsible that cannot be released to support the welfare and resilience of the family. One of the husband obligations that are the right of the wife is to provide the needs for the family. On the contrary, the wife‟s obligation those are the right of the husband is devoted to husband and organized the household needs. Apart from having their respective rights and obligations, husband and wife have mutual obligations those are in educating children. Those are written in Islamic and Indonesian law. But, the implementation is not the entire families can implemented what are their responsibilities. In Depok Sub district, Sleman regency, Special Region of Yogyakarta, it is not uncommon to find husbands who have tried to make living for the family but still need the help of their wives to support the family‟s economy. As the result, wife besides having a domestic role, have to run on the public role. That fact form the basis of this research and aims to explore how the dual role of the wife as a breadwinner in Depok District, Sleman Regency, Special Region of Yogyakarta and find out how Islamic law reviews look at these facts. This field research took analytic descriptive, that descripting results of the research through the narrative writing. The approach used is a normative social juridical based on the ulama madzhab perspective, applicable laws and regulations, and gender theory, that is nature, nurture, and equilibrium. Qualitative data analysis using inductive method, that looking for specific facts and data then used as a general conclusion. The results of this research show that the wives role can run in a good way by the permission and supports of their husband. The wives don‟t make those two roles as a burden to contribute inside and outside household. As for the ulama madzhab Mālikǐ, al-Syāfi„ǐ, Ḥānafǐ and Ḥanbalǐ the wife is allowed to leave the house with the husband's permission, and safety and security are guaranteed for her soul and herself. There is no explicit opinion in Indonesian law regarding the prohibition or permissibility of a wife to looking for the family living. The husband as the leader of family is included in the theory of gender nature and nurture. Husbands and wives who both earn a living for the family are included in the gender equilibrium theory.
