Abstract

Indonesia is a country that adheres to a representative democracy system, in which the people can elect the President and Vice President, DPR, DPD and DPRD through general elections (PEMILU). General elections are held to fulfill the basic principles of democracy, namely people's sovereignty, which means that every citizen has the same right to elect their leader. In Pati Regency, Pati Regency Regional Regulation Number 2 of 2022 regulates Persons with Disabilities. Political rights for persons with disabilities are written in paragraph 9 of article 13. The fulfillment and protection of political rights for persons with disabilities in Indonesia is still a very serious problem, where there is often discrimination in the implementation of political rights fulfillment for persons with disabilities. This research is in the form of analytical descriptive research, the research subjects are determined in a normative juridical way. The validity technique used by the researcher is descriptive analysis. The results of this study found that, (1) KPU Pati facilitates election participants with disabilities without distinguishing persons with disabilities or non-disabilities. (2) The concept of Mukallaf is the underlying concept for them to be entitled to receive their rights and skills regarding rights and obligations. In fulfilling political rights for persons with disabilities in Indonesia by using the concept of mukallaf there are no difficulties in its application. People with disabilities are the same as non-disabled in their skills. They also have the right to be elected or vote.
