Abstract

The election of members of the House of Representatives is interpreted as a forum for popular sovereignty in a democratic state system. However, in its implementation, the election of members of the House of Representatives is undermined by the electoral system used. In the 2004 elections until the 2019 elections, the electoral system used was an open proportional system. This system has given birth to unqualified leaders and candidates for members of the House of Representatives tend to use the practice of money politics to obtain people's votes, so that this can lead to the rampant practice of money politics in the community before the implementation of elections. Therefore, this research will discuss how the weaknesses in the election system for members of the House of Representatives since the enactment of the open proportional system, and explain how a closed proportional system can prevent the potential for money politics in the election of members of the House of Representatives in Indonesia, and explain how the fiqh siyasah review of efforts to change the election system for members of the House of Representatives from open proportional to closed proportional. This research used normative legal research methods, the library materials used in this research are those that are relevant to the problems discussed by the author such as journals, theses, articles, books, magazines and information media. The research approach in this thesis is to use a historical approach and conceptual approach as well as a case approach as an examination of the case of money politics that occurred in the election of members of the House of Representatives in Indonesia. The results of this study based on the analysis conclude that one of the weaknesses in the open proportional system is the practice of money politics which is increasingly widespread in the midst of society so that the use of a closed proportional system can be a solution to the rampant practice of money politics, because this system saves less election damage. in line with that, changes in the electoral system when viewed from fiqh siyasah must be based on the principles of justice and the principle of deliberation, because by considering these principles it can create a better electoral system and bring benefits to all citizens.
