Abstract

There are a variety of approaches to the issue of orphans' inheritance rights. In this study, the Islamic Kecicang community, which does not recognize substitute heirs, views inheritance as kelem. In contrast to the civil and Islamic inheritance laws of Indonesia, which state that heirs who passed away before the heir can be replaced. From the maslahah and structural functionalist perspectives, the authors will look at how inheritance is slow and how it relates to Indonesian Islamic inheritance law. The author of this thesis conducts research through field research. A sociological approach is combined with a descriptive analytic methodology in this study. Techniques for gathering data through interviews, observation, and documentation Using a maslahah scalpel and structural functionalism, the author conducts a qualitatively descriptive analysis of the data following its collection. This study demonstrates that the legacy of a structural-functional perspective on the AGIL scheme can be legally legalized as long as it does not harm anyone or violate Islamic law. As a result, the values of the Islamic religion and humanitarian law can be said to be analogous to the significance of customary law in this society. Orphaned grandchildren are unable to act as substitute heirs for the following reasons: First, grandchildren face mahjub from the siblings of their parents. Second, when their parents pass away, grandchildren either inherit or become heirs. While the principle of "jalbu al-masalih wa dar'u al-mafasid" can be linked to the legacy of the weak perspective of maslahah. Because, at its core, the Kelem inheritance tradition aims to promote good and eradicate evil in order to ensure that benefit-based justice prevails. Then, one way to get rid of ugly things and avoid arguments and have a peaceful inheritance settlement is to give grants to grandchildren out of compassion for them.
