Abstract

The process of resolving sharia economic disputes through mediation at the Klaten Religious Court based on annual data, namely for 2019-2022 shows that out of 19 cases, those that succeeded in conducting peace were obtained in 2020, while those that were partially successful, determined the revocation of lawsuits, ended disputes and failed to mediation will take place in 2019, 2021 and 2022. The problem raised in this thesis research is what is the procedure for resolving sharia economic dispute cases at the Klaten Religious Court? and why is there a failure factor in resolving sharia economic dispute cases at the Klaten Religious Court? This research is a field research (Field Research) using qualitative analysis which is descriptive-analytical with a juridical-empirical approach. The data collection technique used was interviews, library data tracing and studying the decision files of the sharia economic dispute trial process at the Klaten Religious Court in 2019-2022. The results of the study show that first the process of resolving sharia economic disputes through mediation at the Klaten Religious Court uses the legal basis PERMA Number 1 of 2016 regarding mediation procedures at the Court. Second, factors that influence the success of mediation due to law enforcement factors in this case competent mediator judges, factors of supporting mediation facilities and community awareness factors namely the good faith of the parties to carry out mediation are things that influence the success of mediation. Third, the factors that influence the failure of mediation faced by the Mediator at the Klaten Religious Court because of the case factor with the number of defaults being too large and motivated by the level of difficulty of sharia economic cases and the factors of parties who do not want to have good faith in mediating are things that influence failure in mediation.
