Abstract

General elections are a means for the people to show and declare that they are sovereign. Based on Article 201 paragraph (6) Law no. 10 of 2016, Indonesia has an agenda to hold regional elections on September 23, 2020. However, due to Covid-19, the Indonesian government decided to reschedule the regional elections to December 9, 2020 through Perppu 2/2020. This decision caused debate in society because it was considered unrealistic. In fact, until May 16 2020 the number of positive cases of Covid-19 continued to increase. Considering the safety and welfare of the people, the wisdom of a leader must be oriented towards people's rights which aims to bring goodness. So that the Pilkada during the Covid-19 pandemic can still be carried out properly without compromising the safety of the people. In this study, researchers have two problem formulations, namelyFirst, What is the view of public policy regarding the implementation of regional elections during a pandemic. second,How is the view Maqasid as-Syari'ah regarding the implementation of regional elections during a pandemic. The type of research in this thesis is library research(library ressearch). The nature of this research is descriptive. This research approach uses a descriptive approach. The data source used is the primary data source, namely Government Regulation in Lieu of Law Number 2 of 2020, then secondary data which includes books, journals, theses, and other literature. The theory used in this study is public policy theory and theoryMaqasid as-Syari'ah . The results of this study are: 1. The policy for implementing simultaneous regional elections in 2020 in the era of the Covid-19 pandemic in Indonesia has not yet been carried out in accordance with Perppu 2/2020 concerning the Election of Governors, Regents and Mayors. This is based on the elements of the planning, formulation, decisionmaking, implementation of decisions, and evaluation stages of the implementation of these decisions for people who are the targets of the 2020 simultaneous local election policies and can be said to have not been effective. 2. Government policies contained in Perppu 2/2020 concerning the Election of Governors, Regents and Mayors are in accordance with the conceptMaqasid as-Syari'ah . This is based on the analysis conducted by the Compilers, where the essence of Government policy Perppu 2/2020 is to achieve prosperity through maintaining the circulation of the democratic system through the election of leaders, and in its implementation still prioritizing the safety of all elements involved in the implementation of the 2020 Simultaneous Regional Elections in the 2020 era.
