Abstract

Workers' rights are rights inherent to all workers. Workers' rights are regulated by laws and regulations. Law Number 13 of 2003 concerning Manpower and Law Number 11 of 2020 concerning Job Creation regulate workers' rights. Law Number 11 of 2020 revises several articles relating to workers' rights so that the provisions contained in Law Number 13 of 2003 concerning Manpower are no longer valid. This change causes the company to revise the Company Regulations in accordance with the applicable laws and regulations. The rights of workers in this thesis include wages, working time, rest time, overtime, annual leave, long rest, the right to worship, menstruation leave, maternity leave and miscarriage, the right to breastfeed a child, the right to obtain employment social security. Not all employers give rights to their workers and ignore statutory regulations and in some cases show that employers ignore their workers' rights. This thesis looks at how PT Paiton Operation & Maintenance as an employer company regulates the rights of its workers and revises the Company Regulations following Law Number 11 of 2020 Concerning Job Creation. The type of research in this thesis is empirical juridical, namely looking at a legal phenomenon and seeing its implementation in everyday life whether the law has been complied with or not. The research approach used in this thesis is juridical and empirical. Juridical views law as a norm and empirical reality on the ground, whether the law is implemented properly or not. Collecting data for this thesis is using the interview method. The juridical empuris merger is looking at the laws that apply in society and their implementation in the field in the context of this thesis is looking at how the legal arrangements regarding workers' rights and their implementation at PT Paiton Operation & Maintenance. The results obtained are that PT Paiton Operation & Maintenance provides workers' rights to their workers and strictly complies with what is regulated in the laws and regulations so that no violations occur. PT Paiton Operation & Maintenance has also revised the Company Regulations since Law Number 11 of 2020 concerning Job Creation was enacted. There are no significant changes in the PT Paiton Operation & Maintenance Company Regulations only regarding overtime and wages because Law Number 11 of 2020 concerning Job Creation does not change much about workers' rights and some provisions still use Law Number 13 of 2003 concerning Employment.
