Abstract

The establishment of a special election court body in Indonesia still creates problems. The reason is that after the enactment of the Constitutional Court Decision Number 97/PUU-XI/2013 which canceled the authority of the Constitutional Court to adjudicate regional election result disputes, the establishment of a special court body mandated by the Decision has not been realized. As with Article 157 of the Pilkada Law, the special Pilkada court body will become a judicial institution which is actually in handling Pilkada dispute cases which were previously under the authority of the Constitutional Court because prior to the Constitutional Court Decision No. 97/PUU-XI/2013 Pilkada disputes were included in the election regime public and become the realm of the authority of the Constitutional Court. The purpose of this study is to find out the form of a special court that will handle regional elections. This compilation uses the method of drafting normative law by examining local democratic theory and state institution theory. The type of arrangement used is library research (Library Research). The preparation approach used is juridical-normative. Legislation as the primary material, literature such as books, articles and scientific papers as the secondary material. The results of this arrangement show that the special Pilkada Court is designed as a permanent adjudication institution, positioned under the Supreme Court whose jurisdiction includes the High Court for the special court for governor elections and the District Court for the special Court for Regents and Mayors. Regarding the composition of the judges, it consists of career judges appointed by the Chief Justice of the Supreme Court and ad hoc judges from academics who are selected by the selection committee from elements of the KPU, Bawaslu and representatives of community leaders.
