Abstract

At thistime's safe free trade, many cosmetics are on the market, as well as online. Business actors who want to get more profits and limited capital. Therefore, business actors use harmful elements or chemicals used in cosmetic products that do not have a distribution permit, where the ingredients used in these elements or substances will be fatal to the skin because the ingredients used are dangerous ingredients. Consumer ignorance related to side effects caused by cosmetics that are not clear in the content of the product, can be used as a reason for people to continue using these cosmetics. BBPOM Surabaya has identified cases of illegal cosmetic circulation caused by free trade online, resulting in unsafe foreign cosmetic products being able to enter easily without permission to be distributed. Then it raises the question: First, how is the role of BBPOM in efforts to overcome the criminal act of illegal cosmetics circulation in the Surabaya city area. Second, there are only factors that hinder the handling of illegal cosmetics circulation in the Surabaya city area This research is a field study research (fild reserch) and empirical juridical research approach, as well as data collection techniques using interview methods conducted with resource persons from the enforcement and investigation section of the center of drug and food control (BBPOM) in Surabaya and taken from the yearbook of the center of drug and food control (BBPOM) in Surabaya, then developed with a descriptive method Qualitative. From this research, it was obtained that the implementation of efforts to overcome the criminal act of illegal cosmetics circulation in the city of Surabaya can be said to have not been running, maximally, this is evidenced by the increasing circulation or sale of illegal cosmetics from year to year. The reason is due to several inhibiting factors in the form of lack of increased cooperation with the police and law enforcement, the police and the high prosecutor's office and the courts, limited human resources at BBPOM Surabaya. As well as illegal cosmetics sold online, or through invisible distribution networks that are difficult to detect.
