Abstract

Child protection is all activities to guarantee and protect children and their rights in order to live, grow and develop. Regarding the protection and rights of children, children can also do actions that intersect with the law, which can be referred to as Children Facing the Law (ABH). Therefore, the DIY Government has Regional Regulation Number 2 of 2018 concerning the Implementation of Protection of Children, especially in article 59 point b, namely the provision of shelter facilities for ABH. The high number of crimes committed by children in the Special Region of Yogyakarta makes children become one of the ABH. And in article 59, especially in point b, the DIY Government provides protection facilities for Children Facing the Law, which are located at the Adolescent Social Protection and Rehabilitation Center (BPRSR). However, whether when ABH gets the right to provide shelter facilities, the child does not come into contact with the law again or commit the same crime?. The existence of these problems encourages researchers to conduct a study on how the implementation of the implementation of DIY Regional Regulation Number 2 of 2018 for children, especially ABH and how the implementation of DIY Regional Regulation Number 2 of 2018 on children, especially ABH, is viewed from the perspective of maqashid shari'ah. This type of research is field research with the approach used is empirical juridical. The nature of this study is descriptive-analysis, namely by analyzing comprehensively in accordance with the description at the research location, namely the shelter house at the Adolescent Social Protection and Rehabilitation Center (BPRSR). Data collection methods used include observation, interviews, and documentation. The results showed that DIY Regional Regulation Number 2 of 2018, especially in article 59 point b of its implementation, has been going well. Its implementation has generally been carried out in accordance with the concept of human rights and aims at the concept of maqashid shari'ah. However, it should be emphasized to the DIY government that the provision of shelter facilities is not only for ABH as the perpetrator's child. But according to the sound of the article that all ABH children are witness children and also victims children.
