Abstract

In the government systems of Indonesia and Iran, there are clear differences. Indonesia adheres to a purely presidential system of government, whereas, Iran adheres to a presidential and parliamentary system of government. This is written in the Indonesian Constitution in the 1945 Constitution and in the Iranian Constitution in 1989. Likewise with the constitutional model and concept from the point of view of Siyasah Dusturiyah. The concept of separation of powers is divided into three, namely executive, legislative and judicial (Trias Politica). According to Abdul Wahab Khallaf, the important elements in the study of fiqh siyasa dusturiyah consist of three things, the first is the form of government and legislation. Second, respect for individual rights. And third, regarding the areas of power. This study uses normative legal research methods qualitatively (library research). look at the basic provisions in the constitution of the Indonesian state in the 1945 Constitution of the Republic of Indonesia and the Constitution of Iran (1989 Constitution of Iran). The results of the research that has been carried out is that the constitution of the government of the Islamic Republic of Iran is conceptually a development of the Imamate and the Khilafah which is based on the ideology of the Shi'a school of thought where the supreme power is in the hands of the ulama who are institutionalized in Wilayat al faqih, and recognizes that the highest sovereignty is in the hands of Lord. The system of government and the constitution are inversely proportional to the state of Indonesia and the state of Iran. As for the separation of powers, both use the trias politica form, but the distribution of powers is quite different in each country. In the perspective of siyasa dusturiyah, both Indonesia and Iran have national principles which are quite different from the shari'ah that applies in siyasa dusturiyah. However, in several aspects of governance and institutionalization the two countries can be said to be in accordance with the principles of siyasa dusturiyah. Then in the study of the rights and obligations of citizens in the constitution between Indonesia and Iran. Indonesia is more flexible than Iran.
