Abstract

Home is a consumptive need that is almost needed by all people in Indonesia. Bank syariah Indonesia as the largest Sharia Bank in Indonesia is currently trying to provide an alternative in terms of home ownership with the BSI Griya Hasanah product. In terms of giving BSI Griya Hasanah houses, Bank Syariah Indonesia uses murābahah contracts, which today are often included with wakalah contracts. This wakalah agreement is included with the hope and purpose to be able to help and facilitate transactions between banks and customers. But there is also not a few criticisms of the existence of this wakalah contract that it is feared that it will eliminate the essence of murābahah itself, and will also cause gharar in the sale and purchase contract. This study aims to answer the formulation of problems including: to find out the implementation of the murābahah bil wakalah contract at BSI KCP Yogyakarta Kusumanegara; to find out how the murābahah bil wakalah payment scheme at BSI KCP Yogaykarta Kusumanegara; and to find out the review of sharia economic law on the implementation of wakalah contract participation in murābahah financing; This type of research is field research with a descriptive-mormatic approach. While the data analysis method used is descriptive-qualitative. Descriptive-qualitative utilizes qualitative data and is described descriptively, used to analyze events, phenomena, or circumstances socially. In this study, the data collection method used observation, interview, and documentation methods. Sharia economic law theory is used to analyze the suitability of theory with reality. The location of the research was conducted at Bank syariah Indonesia KCP Yogyakarta Kusumanegara. The data sources used in the study are primary and secondary data. And to obtain data, the author uses data collection techniques by means of interviews, observations, and documentation. The result of this study is that the first: the implementation of akad murābahah bil wakalah on BSI Griya Hasanah products at BSI KCP Yogyakarta Kusumanegara in its implementation was carried out on the same day, but the wakalah contract was carried out first and then the murābahah contract. The second is that the murābahah harmony of the bank and customers has been fulfilled, but there are some conditions of harmony that are not fulfilled perfectly. That is, the commodity sold by the bank is not fully legally or principally owned by the bank because the house is purchased on behalf of the customer. And the last payment scheme of murābahah bil wakalah is with an installment scheme similar to the bai’ al-muajjal contract.
