Abstract

The existence of a mandatory halal certification policy in Indonesia provides new rules for business actors to have halal certification, because what was originally voluntary has become mandatory. Business actors must have halal certification for products that are distributed, imported and traded, this is in accordance with the Halal Product Guarantee Law which was later refined into the Job Creation Law and replaced with the Job Creation Perpu. This regulation provides benefits for the public as consumers and as business actors themselves, but in Madiun Regency business actors who have halal certification are still minimal, even though this regulation has been enacted and has a time limit to fulfill. From this background, this research will look at how the juridical analysis and public response to the mandatory halal certification policy are. This research seeks to answer the main questions regarding: How is the public response to halal product certification in Indonesia, especially in Madiun Regency. The main questions are detailed in two questions: What is the juridical analysis of the mandatory halal certification in Madiun Regency?; and How is the response public to the halal certification policy in Madiun Regency. This research is a field research located in Madiun Regency. This study uses a qualitative research method that is analytical descriptive in nature as a knife for analysis using the theory of legal effectiveness from Soerjono Soekanto and a review of the sociology of law from Gerald Turkel. The data collection techniques used are interviews, observation and documentation. Based on the analysis that has been carried out by the author, the research results show that the mandatory halal certification policy in Madiun Regency is quite effective in its implementation, this is in accordance with Soerjono Soekanto's theory of legal effectiveness which contains 5 parameters, namely the factor of the law itself; law enforcement factors; facilities and infrastructure factors; community factors and socio-cultural factors. Seeing the response of the community in Madiun Regency is also increasing regarding the registration of halal certification in Indonesia, this is because there is the SEHATI (Free Halal Certification) program. Meanwhile, in a review of legal sociology from Gerald Turkel, the response public to the mandatory halal certification policy in Madiun Regency is either accepted or rejected. This is in accordance with one of the sociological reviews of law according to Gerald Turkel, namely the belief held by the public in their "the social world" that the response to the mandatory halal certification policy in Madiun Regency is influenced by religious factors.
