Abstract

The Food and Drug supervisory Agency was established and established based on Presidential 166 of 2000 concerning Task Positions. Organizational The Formation of POM Agency was followed up by a 2001 Decree concerning the Organization and Work Procedure of the Drug and Food Control Agency after obtaining approval from the Minister of State No. 34/M.PAN/2001 date February 2001. The type uses field research using a juridical, normative approach while the nature of the research uses descriptive qualitative and the data collection method used is observation, interviews, and documentation. BPOM's research results have violated the supervisory function so that BPOM is responsible in accordance with Article 2 paragraph (1) of Presidential Decree No. 80 of 2017, while responsibility is in accordance with Law No. 8 of 1999 concerning consumer protection in the form of treatment costs and if it causes death will provide compensation to child's family. BPOM's efforts according to the maqaṣid syari'ah are protecting the soul and ḍaruriyah.
