Abstract

West Nusa Tenggara is the first province in Indonesia to have Regional Regulation No. 2 of 2016 concerning halal tourism. This regulation is expected to provide Muslim tourist with more comfort and safety. This newly issued regulation is known as a breakthrough in tourism industry, but raises a number of problems due to less optimal implementation and development, a lack of halal nuances in the tourism destinations, as well as a lack of stakeholder awareness in realizing the development of halal destinations in West Nusa Tenggara. This regional regulation was issued to respond to global developments after the province received an award from Global Muslim Travel Index (GMTI). The field implementation seems unable to compete with the current achievements and the fact that it was mainly aimed to develop halal tourism in this province. Therefore, this study aims to analyze the destination concept, its implementation and the results of the implementation of halal tourism development destinations in West Nusa Tenggara oriented toward mas}lah}ah. This study used Jasser Auda’s maqa>s}id syari>'ah approach as a benchmark for mas}lah}ah. The system approach proposed is based on features consisting of: cognition, wholeness, manifest, thinking hierarchy, multidimensional and meaning as a way to reveal the concept, implementation and results of implementing the development of halal tourism destinations in realizing mas}lah}ah goals. The results of this study are the concept of developing halal tourism destinations, namely the design of tourist objects that serve primary/basic needs (d}aru>riyyah) and supporting facilities that have goodness (mas}lah}a>h) that do not conflict with shari'ah values. The use of cognition, openness and purposefulness dimensions built into the concept of developing halal tourism destinations. The purpose of applying maqa>s}id al-shari>’ah is to apply sadd aż-żarīʻah, namely to prevent damage/immorality (mafsadah). In the implementation of destination development, products, services and management have been implemented according to shari>’ah values in attractions, accessibility, facilities, support services and institutional involvement. This policy is in principle permissible (mubah) as long as there are no prohibited practices in Islam. Implementation with the suitability of maqa>s}id al-shari>’ah with features of the dimensions of cognition, openness and purposefulness in order to realize benefit (mas}lah}ah). The results of this implementation improve the quality of tourist visits, this can increase regional budget revenue (PAD) so that it can reduce poverty. Institutional involvement can provide halal products, services and management to provide a multi-effect in the economic sector of the people of NTB. This is in line with the feature of purposefulness which means opening the way (fath} aż-żarīʻah) to achieve mas}lah}ah and manfa`’ah (benefits or goodness) in encouraging the growth of various social and economic sectors of the people of NTB.
