Abstract

Indonesia is a country that has a lot of regulations. The large number of regulations can cause problem, such as the occurrence of regulatory disharmony. If there are many regulations that become a problem, simplification of regulations through the concept of the omnibus law can be an alternative solution to the problem. The omnibus law method in Indonesia itself is applied to the Drafting of Law Number 11 of 2020 concerning Job Creation, UU No. 6 of 2023. One of the regulations whose changes are included in the law is Law Number 33 of 2014 concerning Guarantees for Halal Products (UU JPH). One of the important things in the law is the implementation of halal product certification. Experiencing various kinds of dynamics, how is the implementation of halal product certification after the changes in the Drafting of Law Number 11 of 2020 concerning Job Creation in UU No. 6 Year 2023? To answer that problem, this research uses a normative juridical approach by collecting data through literature. In this study, the compilers analyzed the text of the law and other legal materials related to the regulation of the implementation of halal product certification. All the collected data was then analyzed qualitatively. The legal materials used in this study include primary legal materials in the form of several laws and regulations as well as secondary legal materials, which include books, scientific journals, and others. The theories used in this research include the theory of the welfare state, the theory of the role of the state, and the theory of human rights guarantees. The results of this study suggest that the implementation of halal certification after the CK Law was carried out by BPJPH. The CK Law, which changed the JPH Law, is in accordance with the concept of a welfare state that pays attention to people's welfare and has a state role in it, namely the government as a regulator forming laws and regulations governing JPH. From the human rights aspect, the Job Creation Law also opens the greatest opportunity for community participation in organizing JPH through Islamic organizations.
