Abstract

Trading in protected animals is a crime according to applicable regulations. The trade in protected animals is a serious threat to the preservation of protected animals in Indonesia. In the Special Region of Yogyakarta, there are frequent cases of buying and selling of protected animals that are sold in markets or through social media. Ditreskrimsus Polda DIY has an important role in uncovering the crime of buying and selling protected animals. Departing from this background, the author questions how the efforts of the Special Region of Yogyakarta Regional Police together with the Yogyakarta Natural Resources Conservation Center reveal and eradicate criminal cases of buying and selling protected animals in accordance with the provisions of Law Number 5 of 1990 concerning the Conservation of Biological Natural Resources and their Ecosystems. This study analyzes the efforts made by Polda DIY in uncovering and eradicating cases of criminal acts of buying and selling protected animals in the 2020-2023 period through the perspective of crime theory and law enforcement. This type of research is descriptive analytical field research with a normative-empirical approach by examining legal behavior products. While the sources of this research were obtained from field interviews and literature related to the object of research. The results of this study found that the Law on the Conservation of Biological Natural Resources and their Ecosystems has not been able to meet the disclosure needs and eradication efforts carried out by the Polda DIY. Low criminal sanctions create a low deterrent effect on society. There needs to be an increase in the sanctions imposed on the perpetrators of the crime of trade in protected wild animals. Perpetrators are hard to find because they sell online. Nevertheless, the Yogyakarta Regional Police succeeded in uncovering the violators of the sale and purchase of these animals and were rewarded according to Law No. 5 of 1990.
