Abstract

In general, incidental parking is parking that is carried out only occasionally when there are activities, events, or crowds. It is not uncommon for this type of incidental parking to cause several problems in its implementation, such as disrupting the smooth flow of traffic when carried out on the road or the edge of the public road, then coupled with the presence of illegal parking attendants, and not infrequently withdrawing parking fees in excess of existing regulations. The existence of these problems certainly raises a question mark about how the clarity of law enforcement and legal protection exists in the management of incidental parking in Yogyakarta City. One of the efforts of the Yogyakarta City Government in overcoming these incidental parking problems is proven by issuing Yogyakarta City Regional Regulation Number 2 of 2019 concerning Parking. This type of research is field research with an empirical juridical approach. While the data analysis method used is descriptive qualitative. In the data collection method, the authors used interviews, observation and documentation. The theory that the authors use to analyze the problem is Soerjono Soekanto's law enforcement theory and Philipus M. Hadjon's legal protection theory. The results showed that, law enforcement in incidental parking management in Yogyakarta City is still not going well. This is because there are still several factors that have not been implemented, such as law enforcement factors, facilities and facilities factors, community factors, and cultural factors. Coupled with there are still some law enforcement officials who do not understand about their authority in organizing incidental parking. Meanwhile, the provision of legal protection carried out by the Yogyakarta City Government has also not been realized, because there is no standard clause that explains clearly, especially due to the lack of understanding of the Officials who have authority in the implementation of incidental parking.
