Abstract

One area in Indonesia that has the potential to produce quality tobacco is Parakan District, Temanggung Regency. Parakan District is one of the areas that produce the most tobacco production. Among the factors causing the large number of tobacco farmers in Parakan District is the economic value of this tobacco plant which can be considered quite high. In addition, being a tobacco farmer has become a culture. However, apart from the advantages of tobacco farming, there are also problems that often occur. One of them is that the pricing is still valid from the middlemen, not from the farmers. Tobacco farmers do not have access to tobacco processing factories. This forces farmers to sell their tobacco through middlemen trusted by the factory. Farmers never interact with the factory, so they never know exactly how much the actual price of tobacco is determined. This condition makes farmers feel that they are being mocked because often the money paid does not meet expectations. The research method used in this research is field research. With the nature of descriptive analytical research. Meanwhile, this type of research is empirical juridical. The data source is the primary data source obtained through direct interviews with a number of farmers and middlemen in Parakan District. In addition, it is supported by secondary data obtained from laws and regulations, books, journals, and other written works related to this research. Data collection techniques through observation, interviews, and literature studies. Meanwhile, the theoretical framework used in this study is the theory of balance and the theory of justice. Based on research that has been done, the practice of buying and selling tobacco between farmers and middlemen in Parakan District, Temanggung Regency does not reflect the principle of balance because the bargaining position of farmers is low so that justice cannot be achieved. The practice of buying and selling tobacco between farmers and middlemen is included in oligopsony agreements where farmers cannot sell their tobacco products to other buyers other than the middlemen. In addition, the practice of buying and selling tobacco is also included in the type of closed agreement and is also included in monopsony activities. Where oligopsony, closed agreements, and monopsony are some of the things that are prohibited under Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition.
