Abstract

There is no provision for the 'iddah period for men who divorce their wives in the texts. Circular Letter of the Director General of Islamic Community Guidance Number P-005/Dj.III/Hk.00.7/10/2021 Concerning Marriage During the Iddah Period The wife urges men not to marry other women while their ex-wife is in her 'iddah period. This study aims to examine more deeply the Circular of the Director General of Islamic Community Guidance Number P-005/Dj.III/Hk.00.7/10/2021 from the Maṣlaḥah (مصلحة ) perspective of Izzudin ibn Abdi Salam. This research is a library research, the nature of the research is descriptive-analytical, normative juridical approach, bibliography writing techniques, primary and secondary sources, as well as analyzing data in a systematic and qualitative way. The method of collecting legal materials uses the library study method related to the discussion of the period of 'iddah and Maṣlaḥah (مصلحة ) of Izzudin ibn Abdi Salam. The results of this study show that there are two conclusions, namely first, that the Circular of the Director General of Islamic Community Guidance Number P-005/Dj.III/Hk.00.7/10/2021 Concerning Marriage During the Iddah Period of the Wife urges husbands not to marry other women after menṬalaq (طلاق ) Roj’ ḭ (رجعي ) first wife who is still in the period of 'iddah. Second, this circular letter contains Maṣlaḥah (مصلحة ) and Mafsadah ( مفسدة ) according to Maṣlaḥah (مصلحة ) Izzudin bin Abdi Salam Izzudin's point of view that the mind can know good and bad. In the sense that if there is a legal provision where there is no text or proposition that regulates it, reason is given priority over the legal provision. Indicators of benefit in this case are avoiding the practice of covert polygamy and creating benefits for ex-husbands and ex-wives. While the Mafsadah (مفسدة ) indicator of this circular letter is the postponement of marriage which is feared will cause harm.
