Abstract

Urinating is one of the normal human biological needs. Seeing the high need to urinate in public spaces makes it easier nowadays with access to toilets in public spaces. such as the option to defecate using a urinal in a public space that makes it easier for users to achieve their goals, more practical and fast to use. However, the presence of the urinal triggers other problems that are thought to be an obstacle to someone using it, such as the alleged difficulty of doing istinjā’ in purification to the health problems of toilet users. The academic problem that has surfaced is how Islamic and health law views the use of urinals in public spaces. to answer this question, This study analyzes how the views of the Lecturers of the Faculty of Sharia and Law and the Lecturers of the Faculty of Science and Technology address the issue of using urinals in public spaces. The opinion of the lecturers from the two faculties was chosen because they are still within the scope of Sunan Kalijaga State Islamic University, one of the Islamic tertiary institutions in Indonesia. In particular, the research is limited to the views of the Sharia and Law Faculty Lecturers and Science and Technology Faculty Lecturers. Based on the problems above, this study proposes two problem formulations. First, what is the opinion of the Lecturer of the Faculty of Syari'ah and Law with the Lecturer of the Faculty of Science and Technology UIN Sunan Kalijaga in the use of urinals in public spaces. Second, how is the use of urinals in public spaces in the fiqh review. This research is qualitative using a normative-juridical approach. The data analysis technique used is descriptive-analysis using the aż-żarī‘ah theory. Based on the data that has been collected and analyzed, this study produced several findings. First, four out of five Sharia and Law Faculty Lecturers position the urinal as a solutive effort in overcoming things that are unwanted by toilet users and their use must be opened as wide as possible. This opinion is included in the branch of the theory of aż-żarī‘ah, namely fath aż-żarī‘ah. Then according to the Lecturer of the Faculty of Science and Technology considering the urinal as an optional tool for defecating, it needs preventive measures in its use because there are allegations of not wearing it from users of the urinal while using it. So it is necessary to have restrictions that are adjusted to the conditions and abilities of its users. This opinion is included in the branch of the theory of aż-żarī‘ah namely sadd aż-żarī‘ah. Second, it is permissible to urinate using a urinal in a public space with due observance of two conditions: it is safe from being exposed to unclean splashes and the private parts are closed from the view of others. Even so, the most recommended is to pee by squatting.
