Abstract

Technological advances have reached a stage where humans are able to create a technology known as Artificial Intelligence (AI) or what is also defined as artificial intelligence. The presence of AI technology itself has provided many conveniences for human life. However, the presence of AI technology is not free from various problems, one of which concerns copyright. This problem stems from the fact that input data including images are required in the development of AI, including images that are protected by copyright. AI development carried out using copyrighted images without permission can certainly result in legal sanctions. This problem not only triggers concerns for the creators but also becomes a challenge for the development of AI in the future. This research aims to analyze and compare the views of the Indonesian Copyright Law and the Saudi Arabian Copyright Law on the use of images without permission, by taking a case study on AI development. This research is a library research. Primary data sources are Law No. 28 of 2014 concerning Copyright and the Saudi Arabian Copyright Law issued through Royal Decree No. M/41 dated 2/7/1424 H, as well as secondary data sources obtained from books, books, journals, and other sources related to the object of the problem in the study. This research is descriptive-comparative in nature, which is done by describing the root of the problem and then analyzing and comparing the two legal perspectives. This research uses the Maṣlaḥah theory of al-Gazālī's perspective to analyze the views of the two legal perspectives. The results of this study indicate that the Indonesian Copyright Law and the Saudi Arabian Copyright Law both recognize copyright as a property that must be protected as property in general. Therefore, both legal perspectives have the same view that the use of images made without permission is basically a prohibited act. Nevertheless, both legal perspectives allow the use of images without permission under certain conditions, namely for non-commercial purposes such as for research or education. In addition, works that have expired their copyright protection period may also be used without permission. Thus, the use of images in AI development can be done without permission as long as it meets the above requirements. However, there are differences in terms of copyright validity period, where the Indonesian Copyright Law stipulates that the copyright period is for 70 years, while according to the Saudi Arabian Copyright Law the copyright period is 50 years.
