Abstract

The large number of neglected elderly people in the Province of DIY as one of the Need for Social Welfare Services indicates that their rights to their basic needs have not been fulfilled and are experiencing obstacles in living life. For this reason, the Yogyakarta Special Region Government issued a policy in the form of DIY Regional Regulation Number 3 of 2021 concerning the Implementation of Elderly Welfare which mandates the existence of an orphanage system for the elderly to ensure the welfare and quality of life of the elderly in the DIY Province. One of the institutions that was established directly under the authority of the DIY Social Service as the executor of local government activities in the field of social welfare is the Budi Luhur Unit Tresna Werdha Social Service Center. From this background, the researchers formulated two main issues, namely how to implement DIY Regional Regulation Number 3 of 2021 concerning the implementation of elderly welfare at BPSTW DIY Social Service Budi Luhur Unit and what is the social impact of elderly services at the Tresna Werdha Service Social Service Center DIY Social Unit Budi Luhur in the perspective of Maṣlaḥah. This type of research is field research. The nature of this research is descriptive-analytic, namely trying to explain the implementation of DIY Regional Regulation Number 3 of 2021 through the elderly service of the orphanage system at BPSTW DIY Social Service Budi Luhur Unit, then analyzed with the theory of human rights and maṣlaḥah. The research approach with empirical juridical means research by looking at a legal reality in society. Data collection techniques using interviews, observation, and documentation. The results showed that the implementation of the DIY Regional Regulation Number 3 of 2021 at BPSTW DIY Social Services Unit Budi Luhur is in accordance with the service standards in the orphanage regulated in the Perda, but still needs to be improved and its implementation in general has been going according to the concept of the rights of the elderly as a vulnerable group to improve their welfare. In addition, if you look at it from the maṣlaḥah perspective, services with an orphanage system for neglected elderly people create benefits that are in accordance with the concept of maṣlaḥah which includes the maintenance of religion, soul, mind and offspring.
